Humanitarian and Compassionate (H&C) Application
Humanitarian and Compassionate (H&C) applications are not meant as an alternative means of immigration, they are intended only for exceptional cases. The processing of an application for either permanent or temporary residency under H&C considerations is a lengthy process and applications are approved on an exceptional basis. A thorough assessment is done to get a complete picture of the factors and circumstances that may suffice to grant the requested exemption by the applicant.
It is important to note that the Humanitarian and Compassionate (H&C) application is NOT the same as a refugee status. An application is assessed on its own merits. An officer weighs the H & C considerations for each application based on the applicant’s circumstances, which means that each application is considered on a case-by-case basis. Eligibility & Program Details
When applying for this program, factors that may be considered include, but are not limited to:
- Establishment in Canada:
- An inability to leave Canada that has led to the establishment
- Ties to Canada
- Best interests of any children affected by your application
- Health considerations
- Family violence considerations
- Consequences of your separation from relative
- Factors in your country of origin
- Any other relevant factors you wish to have considered that are not related to seeking protection
Eligibility
Individuals are eligible to apply for permanent residence from within Canada on humanitarian and compassionate grounds (H&C) if they:

- Are a foreign national currently living in Canada
- Need an exemption from one or more requirements of the Immigration and Refugee Protection Act (IRPA) or Regulations to apply for permanent residence within Canada
- Believe humanitarian and compassionate considerations justify granting the exemption(s) you need; and
Are not eligible to apply for permanent residence from within Canada in any of these classes:
- Spouse or Common-Law Partner
- Live-in Caregiver
- Caregivers: caring for children or people with high medical needs
- Protected Person and Convention Refugees
- Temporary Resident Permit Holder.
