If you’re applying for refugee status, you must be outside of Canada. If you’re applying for protected person status, you can apply from inside or outside of Canada as well. If you’re a refugee, you may be eligible for refugee protection if you’re afraid to return to your home country because of persecution, war, or violence. The United Nations Refugee Agency (UNHCR) or the Canadian government may have already determined that you’re a refugee.

Eligibility Criteria for Canada Refugee & Asylum Program
To be eligible for Canada Refugee or Asylum program you:
- Must not be facing a removal order from the government of Canada
- Must have a valid reason for leaving your current country
- Must have a viable threat to your own or dependent’s life.
On the other hand, you may not be eligible for refugee protection if you:
- Have been convicted of a serious crime and could face punishment in Canada
- Are considered a security risk to Canada
- Are considered a danger to the public in Canada
- Have been denied refugee protection by another country where you claimed refugee status
- Are already recognized as a refugee by another country
- Must not already be a protected person in Canada
- Arrived in Canada through safe third country
- Are not accused of any human rights violations
- Your previous refugee claim was withdrawn prematurely.
Documents & Evidence For Refugee & Asylum in Canada
To support your claim, you’ll need to provide:
- Personal information, such as your name, date of birth, and contact information
- Information about your family, including your spouse or common-law partner and dependent children
- Details about your education, employment, and travel history
- Must have completed a medical examination and have all the reports available for IRB officers.


The Appointment & Interview
After the IRCC receives your application, they will review it on humanitarian and refugee grounds to check your eligibility. If your claim is accepted, the IRCC contacts you to schedule an interview. During the interview, an officer will ask you questions about your application. The purpose of the interview is to:
- Learn more about you and your issues
- Find out more about your claim
- Verify the information in your application
After your interview, the officer will review your application and make a decision. If your claim is approved, you’ll receive a confirmation of refugee status or protected person status. If, however, your claim is not approved, you can appeal the decision to the Refugee Appeal Division (RAD) or, if you’re a protected person, to the Federal Court. You may also be eligible for a Pre-Removal Risk Assessment. This is an assessment of the risks you would face if you had to return to your home country.
Refugee & Asylum Application From Inside Canada
For people inside Canada fearing prosecution or are in danger of being forced to leave the country, you can apply to be a refugee or asylum seeker. This can be done through the Immigration and Refugee Board, which will take a closer look at your case. There are two types of programs that people can apply for: The Refugee and Humanitarian Resettlement Program and the In-Canada Asylum Program.


Refugee and Humanitarian Resettlement Program
The Refugee and Humanitarian Resettlement Program is for people who are outside of their home country and are unable or unwilling to return due to a well-founded fear of persecution. Resettlement refers to the process of bringing a refugee to Canada to live as a permanent resident, by either a government or private group sponsorship. To be eligible for this program, you must:
- Meet the definition of a refugee set out in the Refugee Convention
- Be in need of immediate resettlement and satisfy certain criteria, such as being displaced due to civil war or natural disaster.
In-Canada Asylum Program
The In-Canada Asylum Program is for people who are already in Canada and fear persecution or torture if they return to their home country. To be eligible for this program, you must:
- Make a claim at a port of entry or at a Canadian visa office; and
- Be found eligible to have your claim referred to the Immigration and Refugee Board for a hearing
